The Law of Ukraine no. 4213-IX improving the regulatory framework for the grid connection of renewable generating facilities (the “Law”) came into effect on February 9, 2025. Below is our overview of the key changes introduced by the new Law.
Developers of wind power plants will be able to reserve the necessary capacity for connection to the transmission system by entering into a capacity reservation agreement with PJSC Ukrenergo, the Transmission System Operator of Ukraine (TSO).
The Law suggests that Developers connecting facilities with installed capacity above 1 MW to the distribution system network may take responsibility for design, construction and commissioning of external electrical networks.
Developers will be allowed to commission equipment with an installed nominal capacity higher than the approved one; however, the capacity released to the network may not exceed the permitted capacity.
Developers will be allowed to connect facilities generating electricity from different types of technologies in one connection point (so called ‘hybrid connections’).
The new law suggests allowing to connect energy generating facilities of one producer to the energy networks of the other producer (joint connection) under the conditions:
Implementation of the mechanism described, would be practically possible after introduction of the respective changes to the network codes.
The Law extends the tenure of grid connection agreements and technical conditions for renewables for three years following the effectiveness date provided that the following conditions are fulfilled:
