Olena Perepelynska, Partner and Head of International Arbitration at INTEGRITES, became a speaker at IBA* 2020 – Virtually Together Conference in the session “Advocacy: the dos and don’ts on which senior judges and arbitrators agree and disagree”. The session took place on 23 November 2020.

She told about the written advocacy and its peculiarities for Ukrainian litigation and international arbitration. Having participated as counsel and arbitrator in more than 130 arbitral proceedings in more than 10 jurisdictions, she shared recommendations on how to structure a written submission in a clear, logic and reader-friendly manner.

Among the main principles she relies on while drafting written submission are the following:

  • Include a brief description of the case, its key legal issues and your position in the outset of the submission.
  • Create a logical and easy to navigate submission.
  • Use headings to each section to convey the message to the reader.
  • Use abbreviations to avoid repetition of long titles of laws, documents etc. and add a list of abbreviations helping the reader to easily find what does they mean
  • Use tables, diagrams and other visuals to present information in a very concentrated and easy to digest form.
  • Check your submission and evidence before sending them out to make sure that they do not include any comments or handwritten notes that can disclose some important information.
